Xclusive Recruitment Referral Programme: Terms & Conditions
1. Definitions
XR / we / us means Xclusive Recruitment. Referrer / you means the person or entity submitting the referral. Candidate means the referred individual. "Known to XR" means already in XR's records or CRM, or has contacted XR, been screened, represented, discussed, or submitted by XR (per XR records).
2. Eligibility
2.1 Referrals must be experienced agency recruiters with a minimum of 2 years' agency experience in Australia.
2.2 The Candidate must not have been in active discussion with XR within the previous 12 months.
2.3 You must have the Candidate's prior consent to share their details and for XR to contact them.
3. Submitting a referral
3.1 Referrals must be submitted before the Candidate contacts XR, is submitted by XR, or is referred by anyone else.
4. Valid referral
A referral is valid only if:
4.1 The Candidate is not Known to XR when received; and
4.2 The Candidate completes XR screening; and
4.3 The Candidate attends a client interview arranged by XR.
5. Reward & payment
5.1 The reward is a cash payment of up to $2,000, calculated as a percentage of the total placement fee.
5.2 The reward is payable only if the Candidate: (a) accepts an offer secured via XR, (b) commences employment, and (c) XR receives the placement fee in full (cleared funds).
5.3 Payment timing: within 7 days of XR receiving client payment.
6. First-in rule / disputes
6.1 If multiple referrals are received for the same Candidate, the reward (if any) is payable to the first valid referral received by XR.
6.2 XR's records and decision on eligibility and timing are final (acting reasonably).
7. Exclusions (no reward)
No reward is payable where: the Candidate withdraws or no-shows; employment does not commence; the placement fee is unpaid, part-paid, refunded, or charged back; the Candidate was previously Known to XR or in active discussion within 6 months; or the referral is submitted after Candidate contact, submission, or interview activity has already begun (by any party).
8. Privacy
You warrant that you have the Candidate's consent to share their information with XR. XR will handle personal information in line with applicable privacy laws and XR practices.
9. Tax
Any tax obligations are the Referrer's responsibility. XR may request an invoice or ABN (if applicable) and withhold amounts if required by law.
10. Programme changes
XR may amend, suspend, or withdraw the programme at any time. Changes won't affect rewards already earned under clause 5.2 (unless required by law).
11. Governing law
The laws of Queensland, Australia (or New South Wales if preferred) and the non-exclusive jurisdiction of its courts.
